Senator SPINDLER —I give notice that, on the next day of sitting, I shall move:

  That the Senate—

  (a)welcomes the call by Sydney lawyer Mr Bruce Donald for the introduction of an Australian legal system Act to comprehensively govern the practice of all federal laws;

  (b)notes that such an Act could create an Australian law commission:

    (i)to establish qualifications for admission to national practice,

    (ii)to accredit law schools,

    (iii)to develop rules of practice,

    (iv)to control all federal legal aid funds,

    (v)to ensure that all lawyers and judges are trained in mediation and dispute resolution,

    (vi)to monitor advertising by lawyers, and

    (vii)to establish national complaints and fidelity procedures;

  (c)acknowledges that the Act could open up the services of federal courts and tribunals to disputing parties, if they agree to use them rather than state courts, and would permit any state to amalgamate its court system with the national system; and

  (d)calls on the Commonwealth Government to show foresight and courage and introduce a comprehensive Australian legal system Act as a matter of priority.
