Senator NEWMAN (6.41 p.m.) —I hear Senator Lees's view on this. Of course, the coalition believes that the words `has been or' should be removed because, if the HIC officers are able to enter premises without a search warrant, then to leave `has been or' in the section is making it pretty wide—in our view, too wide. We should note that the police are able to enter premises without a warrant only where they believe an offence is being committed. We are concerned that this is an area where HIC officers are being given powers greater than those given to the police. Although I recognise that Senator Lees's proposal does improve the section, I do not believe it improves it to the extent to which our amendment does. Therefore, I would prefer to proceed with our course of action.
