Senator SPINDLER (8.04 p.m.) —I move:

6.Clause 4, page 8, after proposed section 3F, insert the following section:

Execution of warrant to be tape recorded

"3FA. The executing officer must ensure that the execution of the warrant is tape recorded from the time of entry upon the premises, or if physical force is necessary to gain entry, from the time such force is first applied.".

During the committee hearings, the Queensland Council for Civil Liberties made the point that nearly all police officers now carry field tape-recorders because much state legislation requires the tape-recording of cautions. Thus, the use of these tape-recorders could be extended and should be extended to search procedures in order to provide an important check against abuse of occupiers' rights. Democrats amendment No. 6 seeks to ensure that the whole search procedure is tape-recorded.
