Senator SHERRY (Parliamentary Secretary to the Minister for Primary Industries and Energy) (6.17 p.m.) —This matter, together with clause 48 and another, was the subject of debate this morning concerning the constitutionality of the government's amendments. I table some advice that I indicated would be sought. I understand copies of this advice have been circulated to a number of senators—Senator Short, Senator Watson, Senator Harradine, Senator Coulter and others. In the advice circulated, the last sentence of paragraph five is not in the advice that I have tabled. I point that out for the accuracy of the document. I am sure honourable senators would have picked that up. It is not the government's intention to go on with the amendments this evening. I indicated to Senator Watson, Senator Harradine and possibly Senator Coulter the position we had reached during the course of the last vote. It is our intention to bring this matter on tomorrow to give honourable senators sufficient time to read the advice and to seek further advice on that advice. I intend to report progress.
