Senator HARRADINE(12.48) —I remind the Government that this legislation is yet another example of the improper use of the external affairs power to interfere in an area which is most appropriately dealt with by a State. It should not be forgotten that not only is the State Government of Tasmania opposed to the steps that are being taken by the Federal Government but also the official State Opposition in Tasmania is opposed to what the Federal Government is doing in this area. I believe that any examination of the Convention for the Protection of the World Cultural and Natural Heritage and the interpretations of the High Court of Australia in respect of the external affairs power will show that this is an unwarranted recourse to the external affairs power. I believe that the outcome would certainly be very interesting if this legislation were tested.
