Senator GRIMES (Minister for Community Services)(9.57) —The discretion in this case implements an important element of Government policy. It is the Government's view and, as everyone here knows it is certainly my view, that it is inappropriate to have decisions of this type reviewable in this way. To make discretion reviewable will indeed have the potential effect of frustrating Government policy. As such, the Government relies on the acknowledged exception by the Administrative Review Council to the reviewability of administrative decisions which this category of decision-making represents. For this reason we cannot accept this restriction on the discretion which the amendment proposed by the Democrats would provide.
