Senator CHANEY —My question is directed to the Minister representing the Attorney-General. I refer to the answers he gave earlier in Question Time to Senator Lewis and Senator Collard. I ask him: Does the Government maintain that a dismissal by the Governor-General after the principles of natural justice have been satisfied will completely terminate Air Vice-Marshal Flemming's rights, or will he still be able to challenge the dismissal in the courts on the grounds that he was not guilty of misbehaviour under the Australian War Memorial Act 1980?


Senator GARETH EVANS —To answer that question would be to give a legal opinion, and I do not think that is something that is appropriate for me or any other Minister to do in that situation.
