Senator TATE(5.21) —by leave-I move:

That the Senate take note of the report.

Mr President, in so far as the judge, the subject of the report, is facing committal proceedings in the Castlereagh Street Court of Petty Sessions on 4 March, I think it would be most imprudent for any discussion of the report to be undertaken by honourable senators. Mr President, I know that you would, if the occasion arose, draw attention to the bundle of principles constituting the sub judice rule, but those of us with experience in this chamber know how quickly even apparently cautious remarks can ignite a firestorm of controversy. This is an occasion for utmost restraint in the interests of securing to the judge that atmosphere in which the judicial proceedings can proceed untainted by any remarks made in this place. I seek leave to continue my remarks later.
