Senator MACKLIN(10.14) — The relevant clause is clause 36 which states:

36. (1) No action or other proceeding shall be instituted . . .

As soon as this Bill is proclaimed section 36 will affect everything in the future. One will not be able to institute new proceedings, so we are not talking about any new proceedings. The Minister has said that there are no other continuing cases other than Paterson's curse and that this Bill does not affect Paterson's curse, in which case why are the words in the Bill? If they are not in there for any reason, can we not take them out because they are superfluous?
