Senator Messner asked the Attorney-General, upon notice, on 5 September 1984:

What were the number of bankruptcies classified as business bankruptcies under the Bankruptcy Act 1966 for (i) South Australia; and (ii) Australia, for the period 1 July 1982 to 30 June 1983?


Senator Gareth Evans —The answer to the honourable senator's question is as follows:

The number of bankruptcies classified as business bankruptcies administered under Part IV of the Bankruptcy Act 1966 for the period 1 July 1982 to 30 June 1983 was:

(i) South Australia-258 and

(ii) Australia-2385.

It might be noted that the above figures do not include administrations under Part X of the Bankruptcy Act, that is deeds of arrangement, deeds of assignment and compositions with creditors. By their very nature, a large percentage of these administrations would involve the insolvency, without a formal declaration of bankruptcy, of debtors engaged in business activities.

Total administrations under Part X for the period 1 July 1982 to 30 June 1983 were:

(i) South Australia-50 and

(ii) Australia-884.
