Senator DURACK(10.08) —Two amendments have been circulated on behalf of the Opposition but I am not proceeding with the first one because I am persuaded that the matters that are dealt with in that proposed amendment would in fact be taken into account in the earlier provisions of the legislation . The object of the amendment in relation to clause 31 of the Public Service Reform Bill is to delay the effect of the removal of the appeal rights in respect of the appointments of officers to the Senior Executive Service for a period of two years. That would obviously enable a phasing in period or adjustment period for this new proposal. The Opposition thinks there is some merit in the matter being phased in in this way. I therefore move:

(2) Page 41, clause 31, proposed section 49E, leave out the proposed section, insert the following new section:

' ''49E. (1) The provisions of Division 5 (other than sections 51AA, 51A and 52 ) do not apply in relation to a promotion or transfer to a Senior Executive Service office.

' ''(2) Sub-section (1) has effect only in relation to promotions or transfers occurring after the expiration of the period of 2 years commencing on the day of which section 31 of the Public Service Reform Act 1984 comes into operation.''.' .
