Senator GARETH EVANS (Attorney- General)(12.24) —I move:

Page 20, clause 29, lines 22 to 24, leave out sub-clause (1), insert the following sub-clause:

'(1) Subject to this Division, a member holds office-

(a) in the case of the first Chairman and the first 2 other members-for such period, not exceeding 4 years, as is specified in the instrument of his appointment;

(b) in the case of a member who is appointed after the expiration of one year after the commencement of this Act-for a period ending at the expiration of 5 years after that commencement; or

(c) in the case of any other member-for a period of 4 years,

and is not eligible for re-appointment.'.

This is directed to the composition of the Authority and the tenure of its members. Whereas the original Bill provided for two-year terms, renewable for a period of two years, the present provision allows for one non-renewable appointment for a period of four years in respect of the position of the Chairman and members of the Authority. This is consistent with the Committee's recommendation as to non-renewability. The provision is also set out in such a way as to enable a staggering of the terms to ensure some continuity. There is also a recognition of the constraints imposed by the sunset clause in the Bill in the way in which the provision is drafted, but generally it is a straightforward amendment designed to pick up and adopt the basic recommendation of the Committee in this respect and I commend it to the Committee.


Senator Durack —I just want to ascertain the order in which these amendments should be put.


The CHAIRMAN —The Attorney-General has moved his amendment No. (46) and when I put that the words be inserted you should move your amendment No. (28) which is to change the numbers and then your other amendments will be consequential. The question is:

That the words proposed to be left out (Senator Gareth Evans's amendment) be left out.
