Mr Melham asked the Minister representing the Minister for Defence, upon notice, on 7 October 2003:

(1) What current works or undertakings are declared, under section 6 of the Defence (Special Undertakings) Act 1952, to be special defence undertakings for the purposes of that Act, and where are these works or undertakings located.

(2) What declarations of prohibited areas made under section 8 of the Defence (Special Undertakings) Act 1952 are currently in force and when were those declarations made.

(3) Which persons are currently appointed under section 10 of the Defence (Special Undertakings) Act 1952 to be officers in charge of prohibited areas, when did the appointments take effect and which prohibited areas are involved.

(4) What declarations of restricted areas under section 14 of the Defence (Special Undertakings) Act 1952 are currently in force and when were those declarations made.


Mr Brough (Minister for Employment Services and Minister Assisting the Minister for Defence) —The Minister for Defence has provided the following answer to the honourable member's question:

(1) The Joint Defence Facility - Pine Gap is declared as a special defence undertaking under section 6 of the Defence (Special Undertakings) Act 1952. It is located at Alice Springs in the Northern Territory.

(2) The following land in relation to the Joint Defence Facility - Pine Gap was declared to be a prohibited area under section 8 of the Defence (Special Undertakings) Act 1952 on 2 November 1967 and published in the Gazette in 9 November 1967:

All that piece or parcel of land in the Northern Territory of Australia containing an area of 4398 acres and 20 perches more or less being Northern Territory Portions 930, 931, 932, and 1072 and being described as follows:

- Commencing at a point bearing 179 degrees 30 minutes 15 seconds 2896.6 links; 179 degrees 25 minutes 30 seconds 4451.9 links from the most westerly north western corner of Northern Territory Portion 469; thence by lines bearing 73 degrees 58 minutes 30 seconds 8342.2 links; 179 degrees 59 minutes 30 seconds 13001.8 links; 186 degrees 57 minutes 3808 links; 270 degrees 30 seconds 6351.6 links; 232 degrees 41 minutes 200 links; 268 degrees 25 minutes 30 seconds 1039.5 links; 0 degrees 150 links; 270 degrees 1 minute 16951.1 links; 261 degrees 4 minutes 30 seconds 6479.3 links; 0 degrees 30 seconds 12844.4 links; 78 degrees 32 minutes 30 seconds 5000 links; 84 degrees 11 minutes 12104.8 links; 94 degrees 2 minutes 4000 links; 73 degrees 59 minutes 2510.7 links to the point of commencement.

In 1993 NT portions 930, 931, 932 and 1072 were amalgamated as NT Portion 4130 from plan LT091/006.

(3) In relation to the Joint Defence Facility - Pine Gap the officer in charge for the purposes of section 10 of the Defence (Special Undertakings) Act 1952 is the Deputy Chief of Facility. The instrument of appointment was made on 19 March 1991.

(4) Defence records do not indicate that there are any declarations of restricted areas under section 14 of the Defence (Special Undertakings) Act 1952 currently in force.
