Mr Martin Ferguson asked the Treasurer, upon notice, on 3 December 2002:

(1) Following the announcement that Professor Allan Fels will bring forward his resignation date with the Australian Competition and Consumer Commission to 30 June 2003, what is the end date of Professor Fels contract.

(2) What are the notice, resignation or other arrangements that permit the non-completion of the contract.

(3) What are the financial implications of the early termination of the contract to the Commonwealth.

(4) Will Professor Fels receive any form of payment from the contract after it terminates on 30 June 2003.

Mr Costello (Treasurer) —The answer to the honourable member's question is as follows:

(1) to (4) Professor Fels is a statutory office holder appointed on a full-time basis by the Governor-General under Part II of the Trade Practices Act 1974 (the Act). Accordingly, there is no `contract' of employment. His current appointment term commenced on 6 November 2000 and is set to expire on 30 June 2004. Section 15 of the Act provides that a member of the Australian Competition and Consumer Commission `may resign his office by writing signed by him and delivered to the Governor-General'. If Professor Fels resigns prior to 30 June 2004, he will receive no payments on resignation other than those normally paid in relation to accrued recreation leave and long service leave.
