Mr LIONEL BOWEN (Attorney-General)(9.40) —by leave-I move:

(1) Schedule, page 3, proposed subsection 11ab (1) of the Migration Act 1958, omit ``a person'', insert ``an officer of that Department''.

(2) Schedule, page 3, proposed subsection 11ab (2) of the Migration Act 1958, insert ``(as defined by subsection 5 (1))'' after ``authorised officer''.

(3) Schedule, page 3, proposed subsection 11ab (4) of the Migration Act 1958, omit ``a person''. insert ``an officer of that Department''.

These are purely drafting amendments. Their purpose is to indicate clearly that when the legislation refers to `a person'-for example, a person authorised by the Secretary of the Attorney-General's Department-the person will be an officer of that department. A similar situation applies in relation to proposed sub-sections 11ab (1) and 11ab (4). Proposed sub-section 11ab (2) talks about an authorised officer as defined by sub-section 5 (1). The machinery amendments define that `a person' must be an officer of the Department and they are drafted accordingly.

Question resolved in the affirmative.

Bill, as amended, agreed to.

Bill reported with amendments; report-by leave-adopted.
