(Question No. 4025)


Mr Braithwaite asked the Minister for Trade, upon notice, on 20 May 1986:

(1) What is the current staff ceiling of the Australian Trade Commission (ATC) and how many people does it employ.

(2) How many ATC employees are (a) public ser-vants and (b) were previously employed by his Department.

(3) How many trade commissioners are employed by (a) his Department and (b) the ATC and on what basis are they divided.

(4) How many trade commissioners are (a) public servants or on secondment from the public service and (b) employed on contract.

(5) What guidelines exist for (a) his Department and (b) the ATC covering the employment of public service and contract trade commissioners.

(6) What is the (a) identity of and (b) employment commencement date of trade commissioners who are (i) non-public servants and (ii) public servants or secondees from the public service.

(7) How many (a) public service and (b) contract trade commissioners were employed in the trade commissioner service at 31 March in each year since 1983.

(8) What is the percentage of (a) public service and (b) contract trade commissioners employed since March 1983.


Mr Dawkins —The answer to the honourable member's question is as follows:

(1) The average staffing level limit for the Australian Trade Commission for the period to the 30 June 1986 was 1,327. The actual staff employed at 30 June was 1,334.

(2) (a) and (b) Employees of the Australian Trade Commission are employed under the Australian Trade Commission Act.

644 of the Commission's current employees were previously employed under the Public Service Act within the Department of Trade.

(3) With the formation of the Australian Trade Commission, those Trade Commissioners appointed under the former Trade Commissioners Act whose primary responsibilities were associated with marketing were transferred to the Australian Trade Commission. The Department retained responsibility for those appointees who were primarily engaged in trade policy activities or general agricultural matters and they are employed under the Trade Representatives Act 1985. As at 20 May 1986, there were 137 Trade Commissioners and 19 Trade Representatives.

(4) (a) and (b) In accordance with the provisions of the Australian Trade Commission (Transitional Provisions and Consequential Amendments) Act 1985 137 Trade Commissioners were deemed to be employed by the Australian Trade Commission. Of these 77 were from the Public Service and 60 are employed on term appointments.

All appointees under the Trade Representatives Act had, as at 20 May 1986, public service status.

(5) (a) Appointees under the Trade Representatives Act are subject to terms and conditions set down by the Public Service Board.

(b) Under transitional legislation all staff employed by the Commission, including Trade Commissioners, continue to receive the conditions of employment which they received prior to their transfer to the Commission. These conditions will continue to apply until the determination of an agreed terms and conditions package.

(6) (i) The identity and employment commencement dates of Trade Commissioners in this category employed as at 20 May 1986, were as follows:

* By virtue of the provisions the Australian Trade Commission (Transitional Provisions and Consequential Amendments) Act 1985 the Trade Commissioners Act 1933 was amended and has become the Trade Representatives Act 1933. From 6 January 1986 persons employed under the Trade Commissioners Act 1933 have been deemed to be employed by the Australian Trade Commission. Therefore the Trade Commissioner Service as an autonomous unit has been subsumed into the wider activities of the Commission and there is now no distinction made between employees. However, as the title of Trade Commissioner is understood and accepted by the Commission's clients, it will continue to be used by managerial staff while on posting overseas.
