Mr Carlton asked the Minister for Health, upon notice, on 10 November 1983:

Is he taking steps to compensate Mr R Slaney of P.O. Box 172, Geelong, Victoria , 3220, who has the business name 'Medicare-Doctors' After Hours Service' registered in his name under the Victorian Business Names Act, for damages suffered by Mr Slaney from the use of the name 'Medicare' by the Government; if so, what are the steps he is taking.


Dr Blewett —The answer to the honourable member's question is as follows:

No. I refer to Section 41C (9) of the Health Insurance Commission Act 1973 which states:

(9) ''No action or proceeding, whether criminal or civil lies against the Commonwealth or the Commission for or in relation to the use by the Commonwealth or the Commission of the name 'Medicare' or of an official 'Medicare' symbol.''
