Clause 8, page 11, lines 20 to 21, omit ''nothing in the prescribed provisions of this Act renders unlawful'', substitute ''the prescribed provisions of this Act do not apply in relation to''.

Clause 8, page 11, line 30, omit ''Nothing in this Act renders unlawful'', substitute ''This Act does not apply in relation to''.

Clause 8, page 11, line 36, omit ''Nothing in this Act renders unlawful'', substitute ''This Act does not apply in relation to''.

Clause 8, page 12, line 4, omit ''Nothing in this Act renders unlawful'', substitute ''This Act does not apply in relation to''.

Clause 65, page 50, line 18, after ''receivers'', insert ''to persons intending to operate them''.

The amendments to clause 8 relate to exemptions provided for the Department of Defence, the Defence Force, joint defence facilities, defence research and intelligence activities, the Australian Secret Intelligence Service and Australian security intelligence organisations. The amendments do not seek to alter materially the effect of the Bill for any practical purpose, but they bring the drafting into line with other Commonwealth legislation, specifically the Freedom of Information Act 1981. The amendments remove any suggestion of Parliament having a different intention with respect to the extent of these exemptions in the two Acts. The purpose of the amendment to clause 65 (15), page 50, line 18, is to restrict the scope of regulations under this sub-clause to controls on retailers supplying prescribed equipment to radio users. The fault in the draft as it stands is that wholesalers would be covered by the requirement to sell only to licensed persons and to keep records of such sales. That was not the intention, of course, of the legislation. That is the reason for the fifth amendment, that to clause 65.
