Dispute over validity of referendum

The validity of any referendum or of any return or statement showing the voting on any referendum may be disputed by the Commonwealth, by any State or by the Northern Territory, by petition addressed to the High Court within a period of 40 days following the gazettal of the referendum results. 1 The Electoral Commission may also file a petition disputing the validity of a referendum. 2 Pending resolution of the dispute or until the expiration of the period of 40 days, as the case may be, the bill is not presented for assent.
