Mr Clyde Cameron (HINDMARSH, SOUTH AUSTRALIA) asked the Minister for the Navy, upon notice:

(1) ls he able to' say whether there is a commonly observed practice that contractors, consultants and their clients who carry out work for his Department, refrain from offering employment to employees; of his Department.

(2) i ls it a fact that his Department has a commonly observed practice, of not offering employment to employees of contractors,' consultants and their clients who carry out work for the Department of the Navy.

(3) Has he stated that he ' sees nothing wrong with this practice.


Mr Killen The answer to the honourable member's question is as follows:

(1) and (2) It is a fairly commonly observed practice that reputable Contractors, consultants and their clients refrain' from .offering employment to each other's staff who are' directly involved in the service being provided! The Department of the Navy is sometimes in the position df client in this situation. . ''"'

This does not mean that there is any blanket restriction on the movement . of. staff in and out of the Department. However, when a commercial organisation has been given a contract to perform work for the Navy because, we have insufficient specialist staff to perform .all, [the work ourselves, then my Department would .not expect that the contractor would try to poach, the specialist staff who are employed in the . Department. Neither would my Department offer employment to 'he contractor's specialists who are working on departmental tasks unless it. had consulted with the contractor's management. ''

(3) I have stated in writing . that 1 see nothing wrong with the practice that I. have described in my answers to parts (1) and (2)- of the question.
