(1) welcomes the introduction of the Australian St andard for Olive and Olive-Pomace Oils in 2011 which clearly defines the grade, content and quality of olive oil products and establishes labelling and packaging requirements;
(2) notes the findings of an analysis conducted recently by the Australian Olive Association which revealed that a significant number of imported olive oils in particular, still fail to comply with this national standard;
(3) recognises that misleading labelling practices present considerable challenges for the commercial viability of our domestic olive oil industry, lead to low levels of consumer confidence in olive oil products and prevent consumers from making informed choices about the products they consume, and which may have adverse consequences, including on their health;
(4) welcomes the news that some retailers intend to phase in the voluntary national standard in light of the recent findings, and calls on these retailers to do so in a timely and rigorous manner; and
(5) urges all retailers in Australia to adopt and enforce the Australian Standard for Olive and Olive-Pomace Oils so that consumers can make informed purchasing choices, and so that producers of accu rately labelled olive oils benefit from a level playing field. 2 Mr Oakeshott: To move—That this House endorse the agreements reached in March 2011 at the Fourth Bali Regional Ministerial Conference on People Smuggling, Trafficking in Persons and Related Transnational Crime, in particular the Ministers' agreement to a regional cooperation framework underpinned by the following core principles:
(1) irregular movement facilitated by people smuggling syndicates should be eliminated and States should promote and support opportunities for orderly migration;
(2) where appropriate and possible, asylum seekers should have access to consistent assessment processes, whether through a set of harmonised arrangements or through the possible establishment of regional assessment arrangements, which might include a centre or centres, taking into account any existing sub-regional arrangements;
(3) persons found to be refugees under those assessment processes should be provided with a durable solution, including voluntary repatriation, resettlement within and outside the region and, where appropriate, possible ‘in country’ solutions;
(4) persons found not to be in need of protection should be returned, preferably on a voluntary basis, to their countries of origin, in safety and dignity, and returns should be sustainable and States should look to maximise opportunities for greater cooperation; and
(5) people smuggling enterprises should be targeted through border security arrangements, law enforcement activities and disincentives for human trafficking and smuggling. (a) China is a signatory to the United Nations Refugee Convention of 1951 and its 1967 Protocol, and the United Nations Convention against Torture;
(b) the United Nations High Commissioner for Refugees has been denied access to the North Korean refugee population;
(c) China has a policy of repatriating North Korean refugees to North Korea, returning more than 5000 North Korean refugees every year;
(d) international law prohibits the forcible repatriation, either directly or indirectly, of any individual to a country where they are at risk of facing persecution, torture or death;
(e) babies of repatriated North Korean women are killed through forced abortions and infanticide for being part-Chinese, a practice that clearly violates the United Nations Genocide Convention;
(f) 60 to 70 per cent of the North Korean refugees in China are women, 70 to 80 per cent of whom are without recourse to legal rights or protections and have become victims of sex trafficking, and whose children conceived through rape are considered stateless in China and are vulnerable to trafficking and abandonment;
(g) China considers all undocumented North Koreans as economic migrants, rather than as asylum seekers; and
(h) more than 20,000 North Koreans have defected to South Korea since a famine hit their homeland in the mid-1990s, with almost all of them having travelled through China with the help of Christian missionaries, human rights activists or smugglers, but are still considered by Beijing as illegal migrants, often being rounded up by Chinese police for repatriation;
(2) recognises:
(a) the right o f North Korean refugees to be treated according to the United Nations Refugee Convention; and
(b) and encourages the South Korean Government that is protesting the repatriation by China to North Korea of North Koreans; and

(a) due to the significant increase in offshoring, whereby businesses are relocating their operations overseas, there is a concern for the privacy protection of transferable personal information;
(b) the Government has responded to the Australian Law Reform Commission (ALRC) report 108, and has indicated its intentions to strengthen privacy protection; and
(c) the recommendations and proposals to improve the current legislation need to be further progressed;
(2) recognises that being part of the global economy can improve costs for local consumers and companies but at all times there must be transparency and accountability;
(3) acknowledges that privacy laws in Australia that operate extra-territorially must not contravene privacy protections overseas;
(4) calls on the Government to
(a) adopt a model of Unified Privacy Principles which includes a principle relating to ‘Cross-border Data Flows’, as per the ALRC recommendation; and
(b) amend the Privacy Act 1988 sections pertaining to the extra-territorial operation of the Act:
(i) t o ensure adequate privacy protection for all consumers;
(ii) to ensure small businesses are not exempt from being included in the Act in the provisions relating to the offshore transfer of personal information;
(iii) so that section 5B extends to government agencies, as per the ALRC proposal; and
(iv) to provide consumers with a ‘right to know’ so that service providers disclose the country of origin which provides their services, equivalent to country of origin product labelling. (c) NDIS is a reform that involves the cooperation and support of state and territory governments, the disability support services sector, people with a disability and their families and carers;
(2) notes the bipartisan and cross-party support for the implementation of the NDIS;
(3) declares its support for policy stability on the NDIS over the life of those three Parliaments and until the scheme's full implementation; and
(4) resolves to immediately establish a Joint Select Committee on the National Disability Insurance Scheme which will:
(a) oversee the implementation of the National Disability Insurance Scheme;
(b) be subject to terms of reference to be agreed upon by the Prime Minister and Opposition Leader and ratified by this House;
(c) be comprised of 4 Government members and/or Senators, 4 Opposition members and/or Senators, 1 Greens member and/or Senator and 1 non-aligned member and/or Senator;
(d) be jointly chaired by 1 Government member and 1 Opposition member; and
(e) remain in existence until the full implementation of the NDIS is achieved; and

( a) the criteria outline in the Business Assistance Payments program offered to affected graziers and businesses contained ambiguous wording and was confusing for applicants;
(b) Centrelink staff who advised on applications for the Business Assistance Payments program offered inaccurate advice to eligible applicants; and
(c) applicants who met the criteria missed the deadline for the program because they were misinformed about their eligibility; and
(3) condemns the Minister for Agriculture, Fisheries and Forestry for:
( a) refusing to extend the Business Assistance Payments program to assist affected farmers and businesses who experienced financial losses as a direct result of the live export ban; and

(1) notes that:
(a) Australia needs a diverse economy to prosper now and into the fut ure;
(b) Australia has a strong innovation framework, and some of the best research and development and skilled workers in the world, but industry and government support is needed to turn that capacity into goods manufactured in Australia;
(c) the Australian Government has an agenda for nation building, innovation and improving the productive performance of business and industry, but that more can be done in this area;
(d) the Australian Manufacturing industry should continue to be assisted by government to ensure that the mining boom does not crowd-out every other area of the economy; and
(e) the Government has already made a substantial contribution to the development of this agenda;
(2) reaffirms its belief in a modern, cohesive and comprehensive ind ustry policy for Australian manufacturing which links these elements of the Australian economy;
(3) supports policies to spread the benefits of the mining boom to local manufacturers and the development of a skilled workforce by;
(a) ensuring that the mi ning industry invests in apprenticeships and training to ensure Australia continues to renew and develop a high-skilled workforce; and
(b) requiring:
(i) all new major resource projects have an Australian Industry Participation Plan (AIPP) which provides details of the Australian manufactured materials and services to be used on all major resource developments; and
(ii) open and transparent tendering arrangements which permit Australian industry to compete on an equal basis with international companies for sub-contracts associated with major resource projects;
(4) supports policies that require Australian Government infrastructure and defence industry projects to produce and publish an AIPP detailing Australian manufactured materials and services; and

9 Reducing crime and incarceration rates: Resumption of debate ( from 21 November 2011 ) on the motion of Dr Leigh—That this House:
(1) recognises that:
(a) the Australian incarceration rate has risen from 117 prisoners per 100,000 adults in 1991 to 172 prisoners per 100,000 adults in 2010;
(b) since the Indigenous Deaths in Custody Report was released in 1991, the Indigenous incarceration rate has risen from 1739 prisoners per 100,000 adults to 2303 prisoners per 100,000 adults; and
(c) an increasing number of Australian children have a parent behind bars; and
(2) encourages governments at all levels to pursue innovative policies to reduce crime and incarceration rates, including:
(a) investing in early intervention programs to deter young people from crime;
(b) where appropriate, considering alternatives to incarceration such as weekend detention, periodic detention, restorative justice and drug courts;
(c) employing smart policing strategies, such as using real-time crime statistics to identify and target crime hotspots;
(d) establishing in-prison education, training and rehabilitation programs aimed at reducing recidivism and improving family relationships for prisoners with children; and
(e) implementing randomised policy trials (akin to the 1999 NSW Drug Court randomised trial) to rigorously evaluate the impact of criminal justice interventions. (2) notes that as a result of the attacks, survivor Julian Burton OAM was inspired to found Australia's first burn injury organisation, the Julian Burton Burns Trust;
(3) commends the work of the Julian Burton Burns Trust in implementing burn injury prevention programs, care and support services for burns patients and their families, and advancing world class research into burns treatment;
(4) recognises that:
(a) 220, 000 Australians will suffer a burn injury every year;
(b) Indigenous people living in remote areas are up to 25 times more likely to suffer a serious burns injury than those living in metropolitan areas;
(c) burn injuries cost the Australian Government $1.5 bi llion annually in health care costs; and
(d) the vast majority of burn injuries are preventable; and
(5) supports the establishment of a national burn injury prevention plan to reduce the incidence of burns in Australia and improve research, treatment an d outcomes for burns patients. 13 Asbestos Awareness Week: Resumption of debate ( from 13 February 2012 ) on the motion of Ms Saffin—That this House:
(1) notes that as National Asbestos Aw areness Week is formally recognised, it makes earnest representation to the Government to continue to call on Canada to ratify the listing of chrysotile asbestos in the Rotterdam Convention on Prior Informed Consent;
(2) recognises the proactive actions of the Australian Government in mitigating the possible spread of asbestos-related diseases through continuing bans on the production and use of asbestos as well as strict controls on the removal and disposal of existing material;
(3) commends the Australian Government on a number of measures that have been put into place to manage and compensate the victims of asbestos related diseases which include:
(a) the recent ratification of the International Labour Organization (ILO) Asbestos Convention, as one of the first ILO Conventions to be ratified by the Commonwealth Government since 2006;
(b) Australian leadership on a strong closing declaration by 66 countries at the 2011 Conference of the Rotterdam Convention, which expressed deep concern that the listing of chrysotile asbestos had been prevented by a small number of parties and resolved to move forward to list chrysotile asbestos in Annex III;
(c) the $5 million grant made to support the Asbestos Disease Research Institute Bernie Banton Centre;
(d) funding for the new Australian Mesothelioma Registry, which was launched in 2010 to gather more detailed and accurate information on mesothelioma and asbestos-related diseases;
(e) support for the harmonisation of health and safety legislation which will provide, for the first time, a uniform framework for the minimisation of exposure, the removal of asbestos, and the management asbestos materials in the workplace;
(f) the establishment of the Asbestos Management Review in late 2010 to recommend strategies for the development of a national strategic plan to improve asbestos awareness, management and removal;
(g) the loan agreement with the NSW Government to ensure asbestos victims and their families continue to receive payments through the Asbestos Injuries Compensation Fund; and
(h) the $1.5 million Comcare Asbestos Innovation Fund which sponsors programs and research to prevent and better manage asbestos exposure, as well as improve treatment for asbestos-disease sufferers;
(4) notes the unwelcome inherita nce that asbestos has left on the Australian community, which sees Australian citizens suffering one of the highest rates of asbestos-related diseases in the world, with the effects of asbestos mining still being suffered by many, mostly Indigenous and past employees of James Hardie's operation at Baryulgil in the electoral division of Page, and the poor health and mortality they and their families suffer;
(5) extends its profound sympathies to all individuals suffering asbestos-related diseases as well as their friends and families and the friends and families of those who have passed away as a result of asbestos-related diseases;
(6) notes the current and potential damage that imported asbestos is creating to the people in the Asia Pacific region where, despite these well documented health risks, it remains an attractive commodity due to its low cost compared to other comparable building material;
(7) calls upon the Canadian Government to recognise the potentially catastrophic health and social implications of Canada's production and sale of asbestos and products containing asbestos to these lower socio-economic markets; and
(8) supports the Australian Government in using strong diplomatic efforts to convince the Canadian Government to cease both production and trade in asbestos. 14 Human rights in Iran: Resumption of debate ( from 13 February 2012—Mr Simpkins , in continuation ) on the motion of Ms Parke—That this House:
(1) expresses deep concern to our inter-parliamentary colleagues in the Iranian Parliament regarding serious and systematic human rights violations occurring in the Islamic Republic of Iran;
(2) notes the following from United Nations Secretary-General B an Ki-moon's report on The situation of human rights in the Islamic Republic of Iran released in September 2011, that:
(a) Iran has stepped up its crackdown on human rights workers, women's rights activists, journalists and government opponents;
(b) sinc e the beginning of 2011, Iran has seen a notable increase in the use of capital punishment for political and juvenile prisoners;
(c) Iran has increased discrimination, in some cases amounting to persecution, against a number of religious and ethnic minority groups;
(d) the United Nations continues to hold long-standing concerns in respect of the treatment of the Baha'i community and the trial and sentencing of seven Baha'i community leaders, which did not meet due process and fair trial requirements;
(e) there is limited enjoyment of political, economic, social and cultural rights by, inter alia, Arabs, Azeri, Baloch and Kurdish communities, and some communities of non-citizens; and
(f) since May 2011, security forces conducted raids on the home of individuals involved in the activities of the Baha'i Institute for Higher Education and arrested 15 of its members in various cities;
(3) n otes that in recent months there have been:
(a) further reports of the denial of access to Iranian universities for youn g people on the basis of their political or religious beliefs; and
(b) prison terms of between four and five years imposed on seven Iranian Baha'is in relation to their association with the Baha'i Institute for Higher Education; and
(4) calls on the Nati onal Consultative Assembly of Iran as fellow members of the inter-parliamentary union and as the parliamentary body of a member state of the United Nations, to:
(a) promote and protect fundamental human rights irrespective of origin, ethnicity, sex, relig ion, opinion, or other status;
(b) investigate the denial of access to universities for student activists, Baha'is, and others barred from universities for reasons other than academic capability; and
(c) seeks a judicial review of the trials of prisoners of conscience, including the seven former Baha'i leaders, lawyer Ms Nasrin Sotoudeh, and other human rights defenders and lawyers. (a) under current State and Territory legislation, a coroner does not have the statutory and judicial authority to investigate stillbirths, nor does the legislation (except in Queensland) indicate that coronial jurisdiction extends to stillbirths; an d
(b) there are discrepancies amongst State and Territory legislation over the definition of ‘person’ and ‘death’;
(2) recognises that:
(a) approximately one per cent of babies born every year in Australia are stillborn (cited from a SA stillbirth repor t); and
(b) for many parents, the need to understand the cause of death and further prevent other incidences occurring in the future is important; and
(3) calls on the Government to:
(a) adopt policies and protocols that are consistent amongst the State s and Territories and which specifically outline the circumstances in which a stillbirth should be investigated by a coroner; and
(b) adopt policies which:
(i) provide clear and consistent definitions of ‘person’, ‘death’ and ‘stillbirth’, and extend thi s to other relevant legislation such as the births, deaths and marriages Acts;
(ii) promote the need and development of perinatal specialists in investigations as has been recommended by independent groups such as the Australian and New Zealand Stillbirth Alliance, Perinatal Mortality Group, and Perinatal Society of Australia and New Zealand;
(iii) offer parents the opportunity to have a full and timely assessment of the factors relating to their baby’s death, whilst still respecting their rights;
(iv) allow for public coronial inquiry to assist in identifying clinically important lessons from the death and contribute to research on the topic of stillbirths and early infant death; and

(a) there are increasing reports of gross human rights violations in the Socialist Republic of Vietnam (SRV) including evidence of continued house detention and imprisonment of notable human rights activists including, the Nobel Peace Prize nominee the Most Venerable Thich Quang Do, Patriarch of the Unified Buddhist Church of Vietnam, Reverend Nguyen Van Ly from the Vietnamese Catholic Church, Dr Nguyen Dan Que, Jurist, Dr Cu Huy Ha Vu and the latest jailing without trial of Vo Minh Tri known as Viet Khang, a popular young peace songwriter; and
(b) since 2002, Australia and the SRV have had eight rounds of dialogue on human rights with no apparent results; and
(2) calls on the Australian Government to:
(a) establish and supervise a Vietnam Human Rights Dialogue group that would involve Members of Parliament and Senators, as well as the wider community;
(b) consider the issues of human rights in the SRV when allocating funding under Australia’s overseas development aid program; and
(c) encourage a more “whole of government” approach on bilateral and multilateral bases with the SRV, particularly where the issue of human rights is concerned. (a) on 15 February 2012, Secretary-General of the United Nations, Ban Ki Moon, called for a genuine, all-inclusive and meaningful dialogue that meets the legitimate aspirations of all Bahrainis as the only way to promote peace and stability in the country, and noted the harsh sentences given to 21 political activists, human rights defenders and opposition leaders;
(b) on 23 November 2011, His Majesty Hamad bin Isa Al Khalifa announced his acceptance of a report from the Bahrain Independent Commission of Inquiry headed by Professor M. Cherif Bassiouni where, systematic violation of basic human rights were established;
(c) major international human rights organisations such as Amnesty International, Human Rights Watch, Human Rights First and Physicians for Human Rights expressed their disappointment that the Bahraini regime did not stop the ongoing violation nor stop the impunity given to senior officials responsible, and the United States and European governments are calling for the regime to apply real political reform; and
(d) on 21 December 2011, United Nations High Commissioner for Human Rights, Ms Navanethem Pillay, released a call to Bahraini authorities to address the “deepening mistrust” between the Bahraini Government and civil society, advocating the release of people detained for participating in peaceful protests and calling for confidence-building measures, including unconditionally releasing those convicted in military tribunals awaiting trial for merely exercising their fundamental rights to freedom of expression and assembly, also stating that Bahrain trials bear marks of “political persecution”; and

(3) condemns the Minister for reneging on the promise to restore and rebuild the damaged sea walls on the outer islands of the Torres Strait to protect the island communities from further devastation; and
(4) calls on:
(a) the Minister to publicly comply with the resolution that this House passed on 18 August 2011; and
(b) further calls on the Government to investigate:
(i) any remediation works required to bring the affected sea walls to a standard high enough to prevent tidal flooding;
(ii) the maintenance of sea walls to a safe standard; and

(2) acknowledges the need for a National Autism Plan, including a Forum, to discuss how best to deliver support to families caring for a family member with an Autism Spectrum Disorder;
(3) n otes that:
(a) an Autism Spectrum Disorder is one of numerous disability categories which should be addressed as part of a National Disability Insurance Scheme; and
(b) that 2 April 2012 is World Autism Awareness Day and that the Coalition and Autism Vic toria are working to ensure Parliament House will be lit up in blue to acknowledge World Autism Awareness Day. (1) notes that:
( a) by historical standards, unemployment, inflation and interest rates are at very low levels;
(b) for the first time in Australian history, Australia has a AAA rating from all three major credit rating agencies;
(c) Australia's debt levels, despite the hit to revenues from the global financial crisis, are around one tenth the level of major advanced economies;
(d) OECD Economic Outlook 91 confirms that the Australian economy will significantly outperform OECD economies as a whole over this year and next; and
(e) the IMF has said of Australia: ‘we welcome the authorities’ commitment to return to a budget surplus by 2012-13 to rebuild fiscal buffers, putting Commonwealth government finances in a stronger position’; and
(2) calls upon all M embers to approach economic debates with facts rather than fear, and to put the national interest first when discussing the strong Australian economy. ( Time allowed—50 minutes. )

(c) Australian Workers Union National Secretary, Paul Howes, has said he supports bringing unions' accountability and transparency in line with the Corporations Act 2001 ; and

(1) reaffirms its commitment to the promotion of clean energy industries in Australia in order to develop a sustainable, healthy and safe energy future for our country;
(2) recognises:
( a) that the expansion of Australia's wind energy industry is of critical importance in promoting Australia's energy security while decreasing pollution;
(b) the importance of the wind energy industry in ensuring, in the most cost effective manner, that 20 per cent of Australia's electricity supply will come from renewable sources by 2020; and
(c) the considerable opportunities for increased employment, industry and regional development which are, and will continue to be, generated by the Australian wind and general clean energy sector; and
(3) expresses its profound concern that, through the imposition of unreasonable planning restrictions on wind farm developments, State governments risk creating investment uncertainty for the wind energy sector and forfeiting the local jobs and industries that will be created as we move to a clean energy future.
