Senator XENOPHON (South Australia) (21:15): On the minister's response, is the minister therefore saying that the burden of proof for their penalties is one of a balance of probabilities rather than a higher evidentiary burden? Can he confirm what is the actual evidentiary burden for this penalty regime?
