Senator O'BRIEN (7:31 PM) —I will deal with the opposition's position on these amendments. Amendment (4) includes an environment group on the list of those to be consulted when a determination is made by the commissioner on what operation of a journey constitutes a journey. Labor certainly supports the inclusion of an environment group in those to be consulted, so we support amendment (4). Amendment (5) makes the determination of the commissioner on what operation of a journey constitutes a journey a disallowable instrument and introduces a public consultation process. In the interests of good public policy and accountability, Labor will also support this amendment. We will also support the exclusion of turtles and dugong from the meaning of fish for the purposes of the Energy Grants (Credits) Scheme Bill 2003. We think that is entirely appropriate and taxpayer funds should not be used to subsidise fishing activities that catch either of these protected species.
