Senator BOSWELL (Leader of the National Party of Australia in the Senate and Parliamentary Secretary to the Minister for Transport and Regional Services) (10:47 AM) —While I get that information, I want to clear up one point. I never suggested it was a conspiracy. You quote me as saying that. What I said was that Mr Boyd Munro of Air Safety has incorrectly suggested that some form of conspiracy is involved with this legislation. I never suggested it was a conspiracy. I think it is a very serious piece of legislation and it needs full examination, and that is what we are giving it at the moment.

While we are still getting this information, I will respond to Senator O'Brien. I am informed that the wording, as it is now, meets the Criminal Code defence and the Criminal Code defence would apply. The Attorney-General has given us that advice. The alternative phrasing is too vague. It is better to use a defined set of circumstances. That is the information I have in response to your inquiry.
