Senator ROBERT RAY (9:34 PM) —I want to comment on one point raised by Senator Greig. He is right that there is a provision in the ASIO legislation—but not, I think, this one—where the director-general can issue a warrant in the absence of the Attorney-General, but it is an unusual step. It is then subject to review—and this case was subject to review by the inspector-general; it was in his report. He looked at the circumstances and validated ASIO's actions on this occasion. The provision is there for that reason. But it is not an unfettered right of the director-general. It is subject to review, it was reviewed and it was validated by the inspector-general.
