Senator ELLISON (Minister for Justice and Customs) (6:13 PM) —I understand that both of those people have seen representatives of Australian law enforcement and ASIO. I do not believe—and if it is not correct I will correct it—that they have had access to legal counsel. Senator Brown makes a comparison between the situation under which they are held and that under which they would be held on an indictable charge here in Australia. They are not held in Australia, it is not within the Australian jurisdiction and we do not believe that you can draw the analogy between being held here in Australia under the due process of Australian law and being held there under that law.
