Senator HARRIS (8:15 PM) —Pauline Hanson's One Nation has not cried foul on the decision of the High Court. We have not at any point in time made a statement that their judgment was anything other than as it should be under the Constitution. Pauline Hanson's One Nation has not at any time purported to have a list of any members who are ineligible. If the Senate or the senators have missed an issue in this debate, it is that they have the opportunity to put before the Australian people their eligibility. One of our senators raised the issue of discrimination between (a) and (b) in the motion. What that does is clearly set out the two instances and the differences between a person who is born in Australia and somebody who is born overseas. No other senator has drawn attention to the issue that a person born in Australia would be ineligible under section 44 if they had any allegiance to a foreign power. We could be Australian born and still ineligible under section 44.

I have the greatest of respect for this chamber and for the Australian people. Senators now have the opportunity to respect both the Constitution and the Australian people and to confirm their eligibility. Senators have, on one hand, spent a considerable amount of time in debating the motion—and I commend them for their input in debating section 44 of the Constitution; on the other hand, they accuse Pauline Hanson's One Nation of wasting taxpayers' money in raising this standing order. Their input into the debate contradicts their claim that we are wasting the Senate's time. The Senate will be measurably better when senators refer to issues when debating and when they refrain from making personal attacks on individuals. The Senate will, in the eyes of the Australian people, be greatly improved for this protocol. I have the courage of my convictions and, within 10 days of this motion being put, I will table the documents I have requested of other senators. I commend to each other senator individually to consider doing the same.

The ACTING DEPUTY PRESIDENT (Senator Calvert) —The question is that the motion moved by Senator Harris be agreed to.

Question resolved in the negative.

Senator Harris —Mr Acting Deputy President, I would like to have my yes vote on the motion recorded in Hansard .
