Senator FORSHAW (12:09 PM) —The intention of what we put forward was to ensure that any such facility is one that is contemplated at the moment, such as the intermediate or low level waste storage facility called for in the Senate select committee report. Indeed, we are certainly prepared to support Senator Margetts's amendment. We believe it ensures that the act will not authorise the construction of any larger facility, having in mind, for instance, one which could deal with imported waste and reprocessing to the enrichment stage. That is really what there has been some public discussion about in recent days.

The ultimate situation is that, whilst the definition of `nuclear installation' includes a nuclear waste storage or disposal facility, the regulations will limit the operation of any such facility. Clearly, if clause 9A(1)(e) is carried, the act would not authorise the construction of such a facility beyond what is set in the regulations. I hope that is clear. That is why we do not see any contradiction between carrying proposed clause 9A and the amendment that we have just carried.
