Senator MURRAY (3:59 PM) —I accept the decision of the committee. For the record, that phrase is plucked from recommendation 6.1 of the fair trading report. Many of those recommendations have been reshaped and wound into your own section, Parliamentary Secretary. One obvious example is their 2L which referred to the good faith of the parties. You have included that and so on. It was a specific intention to carry over one that was left out. I accept your reasons and understand them, but I do think if ever this section is revisited that we should have a look at some of the case law and see whether the harshness of the result was not, in fact, attended to.
