Senator KEMP (Assistant Treasurer) (12:46 PM) —I move:

(1) Schedule 2, item 5, page 40 (after line 33), after subsection (2), insert:

(2A) The Commissioner or the inspector must not exercise the power conferred by subsection (1) to enter residential land or residential premises if the occupier of the land or premises has not consented to the entry.

This amendment is designed to protect the rights and liberties of individuals by restricting the search and entry power contained in the investigation and enforcement provisions of the bill relating to the new security arrangements for Lloyds.

I table the supplementary explanatory memorandum relating to the government amendment to be moved to the bill. This memorandum was circulated in the chamber on 31 March. This amendment has been discussed with the relevant parties in the Senate. My understanding is that we have agreement to it.
