Senator STOTT DESPOJA (4:55 PM) —I thank the government for agreeing to accept this amendment in relation to satisfactory progress. As I said earlier in the debate, I note there is concern from the Greens WA as to the definition of `satisfactory progress', the idea of that being left up to the secretary's opinion. We are moving to assert a definition that will be set by ministerial guidelines and that will be a disallowable instrument.

As I acknowledged earlier, I think this alleviates some of the concerns that Greens WA might have. In fact, we acknowledge that, while there is a degree of flexibility through the government's drafting of this particular legislation, we also want to ensure that this system is not open to abuse, so there is no punitive element to satisfactory progress or defining satisfactory progress. We think this is one way of ensuring that it is transparent, reasonable and accountable and making it a disallowable instrument as well.
