Senator BOLKUS(4.25 p.m.) —I propose to move the following amendments:

(142)   Schedule 1, item 9 at the end of section 36, add:

      Commonwealth Minister may give notice as to urgency

   (4)   At any time after the end of the period applicable under subsection (1) in respect of an application under section 35 that has not been withdrawn, and before either:

      (a)   the negotiation parties have made an agreement of the kind mentioned in paragraph 31(1)(b); or

      (b)   the arbitral body has made a determination under section 38;

      the Commonwealth Minister may give a written notice to the arbitral body requesting the arbitral body to make such a determination within the period specified in the notice. The period must end not earlier than 30 days after the day on which the notice was given.

Senator Minchin —Can I be reminded of the content of those.


Senator BOLKUS —What we have done is to impose a regime where, before ministerial intervention, there needs to be a notification period of 30 days and so on. I think you found that a much more acceptable course to have in the legislation than a total prohibition.


The TEMPORARY CHAIRMAN —Senator Bolkus, I do not know that they have been circulated. We do not have a copy of them. It might be appropriate that they are.


Senator BOLKUS —My understanding is that this course of action was acceptable to the minister and his advisers not because it is their preferred course of action but it was preferable to them than having a total deletion of 36A to C. You are right. They may not have been circulated.


The TEMPORARY CHAIRMAN —I am just informed that we need them, so we might postpone this.


Senator BOLKUS —So what you are saying is our deletion of 36A to C is not effective at this stage.


The TEMPORARY CHAIRMAN —We will just postpone it for a short time and go to page 2. Senator Margetts, are you intending to proceed with Democrat-Green amendments 134, 133 and A2?
