Senator MARGETTS(11.46 a.m.) —If a person has been put in a pool of people who can be selected, you would have to be fairly reasonably assured that that person may have a chance of being selected at one stage. Why would you put a person in a pool of people to be selected and say, `But they are not actually going to be picked'? It does not hold water. This is the circumstance now. We have a person without legal qualifications on there now. We have no indication what will happen in the future. We have nothing to indicate that something will or will not be done.

That brings me to my second point. Senator Murray has indicated that, because he has not indicated how the Democrats will vote in this debate, their position is being misrepresented. Fine. This is the opportunity. Why don't you advise the chamber how the Democrats will vote at the third reading stage then everybody will be disabused of the position the Democrats are taking.
