(35) Schedule 7, item 10, page 62 (line 19), omit "An application", substitute "Subject to subsection (4), an application".
(36) Schedule 7, item 10, page 63 (line 1), omit "If", substitute "Subject to subsection (4), if".
(37) Schedule 7, item 10, page 63 (after line 11), at the end of section 170HC, add:
(4) This section does not prevent a person whose employment may have been terminated for reasons of, or including, race, colour, sex, sexual preference, transgender identity, age, physical or mental disability, marital status, family responsibilities, pregnancy, religion, political opinion, national extraction or social origin, from taking proceedings under any or all of the following:
(a) the provisions of this Act;
(b) another law of the Commonwealth;
(c) a law of a State or Territory.
These amendments provide options for action in the event of dismissal for discriminatory reasons. We provide for persons dismissed for discriminatory reasons to take action under the provisions of the act even if they have commenced action under another law of the Commonwealth or a law of a state or territory.
