To the honourable senators in the Senate assembled:

I beg the Senate to inquire into the number of nursing homes, particularly small nursing homes, disadvantaged to the point of devastation as a consequence of decisions made by officers of the Department of Health and Family Services where the decisions are

(a)   contrary to law on the one hand and/or

(b)   contrary to published circulars (non-reviewable at law) on the other hand.

I beg the Senate to ensure that safeguards are set in place to ensure that, in the future, nursing home proprietors severely disadvantaged by Department of Health and Family Services decisions have a fair and independent opportunity for review of those decisions—Administrative Review Council report No 37 refers.
