Senator TAMBLING (Parliamentary Secretary to the Minister for Transport and Regional Development)(3.57 p.m.) —The government will not be opposing these amendments but, once again, I draw some poor drafting to your attention. With regard to amendment (3) proposed by Senator Margetts, I propose that you delete the words following `400 penalty units'.

Amendments (2) and (3) substantially increase the penalties for offences relating to airport developments not being in accordance with approved major development plans. While the levels of penalties are disproportionate to penalties for other offences under the act, the government does not intend to oppose these two amendments.

Mr Chairman, as I just pointed out to you, amendment (3) is technically deficient. Therefore, it is suggested that the you delete the words following `400 penalty units'. The reason for this is that section 4B of the Crimes Act will automatically apply the higher penalty in respect of bodies corporate which constitute a wider class of entities than companies to which the amendment refers.
