Senator SPINDLER (6.26 p.m.) —I move:

1.Clause 4, page 2, proposed subsection 3C(1), definition of "executing officer", paragraph (c), lines 24 and 25, omit the paragraph.

The bill currently enables the name of the executing officer—that is, the policeperson—to be changed twice after the warrant has been issued. The Australian Democrats do not believe that the person who conducts the search should be able to be twice removed, as it were, from the person who was originally given the authority to conduct the search. This amendment allows the name of the police officer to be changed only once.
