Mr Robert asked the Attorney-General, in writing, on 17 September 2009:

(1)   How many (a) Regulations, and (b) other legislative instruments, have been made under powers delegated by an Act of Parliament since the Government took office on 3 December 2007.

(2)   How many new regulatory requirements have been imposed directly by Acts of Parliament since the Government took office on 3 December 2007.

(3)   How many (a) Regulations, (b) other legislative instruments, and (c) regulatory requirements imposed directly by an Act of Parliament, have been repealed since the Government took office on 3 December 2007.


Mr McClelland (Attorney-General) —The answer to the honourable member’s question is as follows:

Answers are given as at 29 September 2009:

(1)  

(a)   512 sets of Regulations have been registered on the Federal Register of Legislative Instruments (FRLI) since 3 December 2007.

(b)   7825 other new legislative instruments have been registered on FRLI since 3 December 2007.

(2)   251 Acts have received Royal Assent since 3 December 2007, of which 61 are principal Acts and 190 amending Acts. A number are currently awaiting Royal Assent. The extent to which these Acts impose regulatory requirements, and the extent to which any regulatory requirements are new (rather than replacing or amending existing ones) would give rise to difficult issues of judgement and could only be assessed on a case by case basis.

(3)  

(a)   57 sets of Regulations have been repealed or are otherwise shown as having ceased (eg as being spent or impliedly repealed) on FRLI since 3 December 2007.

(b)   3454 other legislative instruments have been repealed or are otherwise shown as having ceased on FRLI since 3 December 2007.

(c)   43 Acts have been repealed since 3 December 2007. Individual provisions in other Acts may have been repealed by the amending Acts mentioned in the answer to question (2). See also the comment provided in the answer to question (2).
