Mr ABBOTT (Minister for Employment and Workplace Relations and Minister Assisting the Prime Minister for the Public Service) (12:24 PM) —by leave—I present a supplementary explanatory memorandum to the bill and move government amendments (1) to (3):

(1) Schedule 1, item 4, page 3 (line 23), after “provision”, insert “, or purported provision,”.

(2) Schedule 1, item 9, page 5 (after line 4), after subsection (1), insert:

(1A) Nothing in this section prevents an industrial association from demanding payment of a bargaining services fee that is payable to the association under a contract for the provision of bargaining services.

(3) Schedule 1, item 9, page 5 (after line 14), after section 298SB, insert:

298SBA Industrial associations not prevented from entering contracts

To avoid doubt, nothing in this Division prevents an industrial association from entering into a contract for the provision of bargaining services with a person who is not a member of the association.

These are very technical amendments. They are designed to address issues that were raised in the Senate committee process and to ensure that arrangements which are indeed voluntarily entered into are not struck out by the legislation. I commend the amendments to the House.
