Mr McClelland asked the Attorney-General, upon notice, on 15 February 2000:

Has any Consumer Price Index (CPI) or Average Weekly Earning (AWE) increase been applied by the Commonwealth Government to Legal Aid funding since 30 June 1996; if not, is he able to say what additional funds would be required in both percentage and financial terms for each of the financial years since 30 June 1996 to factor in both CPI and AWE increases.


Mr Williams (Attorney-General) —The answer to the honourable member's question is as follows:

Prior to 1 July 1997, funding for legal aid commissions was indexed by reference to movements in Average Weekly Earnings (AWE) and the Consumer Price Index(CPI).

As a result of a review of indexation of Specific Purpose Payments (SPP's) by the Department of Finance and Administration it was decided that funding for legal aid commissions would be adjusted by a composite index of 60% Safety Net Adjustment (SNA) and 40% Treasury Measure of Underlying Inflation (TMUI) from 1 July 1997.

From 1997-98 to 1999-2000, funding for the legal aid program was adjusted by the composite index as indicated above. The adjustments in each year were as follows:- 1997/98 - 1.3%; 1998/99 - 1.8%; 1999/00 - 1.9%.
