(1) records its abhorrence at the events of 16 to 18 March 1988 at Halabja, Kurdistan, involving the use of chemical weapons by the then Iraq r egime of Saddam Hussein;

(a) the death of 5000 civilians and injury of 7000 people;

(b) the use of a mixture of Sarin, VX and Tabin nerve gases in addition to mustard gas, leading to birth defects, miscarriages, infertility, paralysis, cancer s and other illnesses;

(c) that this massacre was only part of the broader ‘Arfal’ 1987 to 1988 assault on the Kurdish people aimed at ethnic cleansing; and

(d) the execution of Ali Hassam Almajid on 25 January 2010, after being found guilty of ordering and organising this attack; and

(3) acknowledges:

(a) resolutions in a similar vein carried by the United States Senate and House of Representatives, and in the Canadian, Iraqi and British parliaments; and

*3   Mr Danby: To move—That this House:

(1) recognises that 24 March is World T uberculosis Day, in observance of a preventable and treatable disease that still claims the lives of up to 1.5 million people every year, mostly in developing countries, and that:

(a) overall, one third of the world's population is currently infected with the T uberculosis bacillus;

(b) the World Health Organization (WHO) estimates that the largest number of new Tuberculosis cases in 2008 occurred in the South-East Asia Region, which accounted for 35 per cent of incident cases globally; and

(c) the number of new cases of Tuberculosis arising each year is still increasing in Africa, the Eastern Mediterranean and South-East Asia;

(2) acknowledges that T uberculosis is responsible for one in four AIDS related deaths, making it the leading killer of people living with HIV and that:

(a) less than seven per cent of people living with HIV are screened for Tuberculosis;

(b) people living with both HIV and Tuberculosis infection are much more likely to develop Tuberculosis; and

(c) the WHO estimates that by scaling up services and providing integrated HIV and Tuberculosis care, it is possible to save the lives of up to one million people living with HIV by 2015;

(3) notes that:

(a) currently more than two thirds of international financing for T uberculosis services is provided by the Global Fund to Fight AIDS, Tuberculosis and Malaria;

(b) the Global Fund is a key international body which provides critical basic services to support many developing countries in the fight against Tuberculosis; and

(c) Australia strongly supports the Global Fund; and

(4) encourages Australia to continue to work bilaterally and with other international donors to address Tuberculosis, including through the Global Fund. ( Notice given 13 March 2012. )

(1) notes that the Australian agricultural industry offers excellent career opportunities, including:

(a)  approximately 100,000 jobs in the agricultural sector;

(b) 2.5 jobs for every agricultural graduate; and

(c) a diverse range of careers requiring a wide range of skill levels;

(2) acknowledges that responding to the expanding global food task will require Australia to substantially upskill and increase the size of its agribusiness workforce;

(1) notes that:

(a) on 11 July 1995, the Bosnian town of Srebrenica, which was at that time proclaimed a Protected Zone by the United Nations Security Council Resolution of 16 April 1993, fell into the hands of the Army of Rep ublica Srpska led by General Ratko Mladic and under the direction of then President of the Republica Srpska, Radovan Karadzic;

(b) from 12 July the Army and the Police of Republica Srpska separated men aged 16 to approximately 60 or 70 from their families;

(c) Bosnian Serb forces killed over 7000 Bosnian Muslim men following the takeover of Srebrenica in July 1995;

(d) all of the executions systematically targeted Bosnian Muslim men of military age, regardless of whether they were civilians or soldiers;

(e) the acts committed at Srebrenica were done with specific intent to destroy in part the group of Muslims of Bosnia and Herzegovina and as such, were acts of genocide, committed by members of the Army of Republica Srpska in around and Srebrenica from about 13 July 1995; and

(f) these findings have been confirmed by the International Court of Justice and the International Criminal Tribunal for the former Yugoslavia through final and binding judgements; and

(1) irregular movement facilitated by people smuggling syndicates should be eliminated and Stat es should promote and support opportunities for orderly migration;

(2) where appropriate and possible, asylum seekers should have access to consistent assessment processes, whether through a set of harmonised arrangements or through the possible establish ment of regional assessment arrangements, which might include a centre or centres, taking into account any existing sub-regional arrangements;

(3) persons found to be refugees under those assessment processes should be provided with a durable solution, in cluding voluntary repatriation, resettlement within and outside the region and, where appropriate, possible ‘in country’ solutions;

(4) persons found not to be in need of protection should be returned, preferably on a voluntary basis, to their countries of origin, in safety and dignity, and returns should be sustainable and States should look to maximise opportunities for greater cooperation; and

(5) people smuggling enterprises should be targeted through border security arrangements, law enforcement activities and disincentives for human trafficking and smuggling. (c) the Senate Community Affairs Reference Committee's report, The Social and Economic Impact of Rural Wind Farms has, as a matter of priority, called for adequately resourced studies into the possible impact that wind farms have on health;

(5) recognises that the National Health and Medical Research Council's rapid review into Wind Turbines and Health is only a cursory compilation of literature on the topic and not an in depth study and should not be principally relied upon to inform planning guidelines;

(6) calls on the Government to urgently commence full in-depth studies into the potential health effects of wind turbines, especially low-frequency infrasound;

(7) requests that the Government fully investigate international best practice in planning policies regarding wind farms and, in conjunction with State governments, publish comprehensive updated guidelines;

(8) calls on State, Territory and local government authorities to adopt cautious planning policies for wind farms and in the interim provide adequate buffer zones and not locate wind farms near towns, residential zoned areas, farm buildings and workplaces; and

(9) calls for approval processes to require wind farm developers to indemnify against potential health issues arising from infrasound before development approval is granted. (a) the motion tabled in the South Australian Parliament on 28 July 2011 by Mr Tony Piccolo MP, Mem ber for Light, which acknowledges the experience of 'enemy aliens' interned during World War II and seeks to record an acknowledgement in similar terms by the Commonwealth Parliament on behalf of the nation; and

(b) that during World War II thousands of people were interned in camps around Australia as ‘enemy aliens’ and prisoners of war, and among the 'enemy aliens' interned were permanent Australian residents born in Australia or who had become British subjects in accordance with the Federal immigration and citizenship laws of the day;

(2) acknowledges that:

(a) of these people interned at the camps, the overwhelming majority were law-abiding members of the Australian community who posed no security threat, indeed they were people who had made a valuabl e contribution to Australian society and so their internment was not only a hardship to them and their families, but also a significant loss to the communities to which they belonged; and

(b) ‘enemy alien’ internees were deprived of their freedom and consider that this was primarily on the basis of their ethnic and cultural identity under the mistaken belief that this cultural heritage posed an unreasonable risk, and not for any demonstrat ed or valid security concerns;

(3) notes:

(a) the substantial research and personal histories that demonstrate that the internment experience had a long term, detrimental impact on the physical and psychological health and wellbeing of many of the people interned; and

(b) that two thirds of all Italian internees were interned in the states of Western Australia and Queensland, including more than 1000 in Fremantle, and that certain communities and industries were particularly affected by the internment policy;

(4) recognises and acknowledges the pain, suffering, grief and hardship experienced by the people who were interned and their families, and in particular, the impact on mothers and wives who were left to care for children, homes, farms or businesses alone;

(5) congratulates those internees and their families who made the decision to remain in Australia and rebuild their lives following internment and/or other discriminatory treatment including the inability to buy or lease land, or obtain bank loans, the prohibition against travel, and the confiscation of torches, radios, cameras, trucks and tractors;

(6) celebrates the lives of those former internees and families, and those wrongly classed as ‘enemy aliens’, who despite their experiences went on to make a significant contribution to the economic, social and cultural development of Australia; and

(7) expresses the hope that as a maturing nation we have learned from the experiences of the World War II policy of internment and that we should ensure that current and future generations of migrants to this country, and their descendents, are treated with justice and equality before the law, and not discriminated against on the sole basis of their cultural heritage. (i) all new major resource projects have an Australian Industry Participation Plan (AIPP) which provides details of the Australian manufactured materials and services to be used on all major resource developments; and

(ii) open and transparent tendering arrangements which permit Australian industry to compete on an equal basis with international companies for sub-contracts associated with major resource projects;

(4) supports policies that require Australian Government infrastructure and defence industry projects to produce and publish an AIPP detailing Australian manufactured materials and services; and

(2) encourages governments at all levels to pursue innovative policies to reduce crime and incar ceration rates, including:

(a) investing in early intervention programs to deter young people from crime;

(b) where appropriate, considering alternatives to incarceration such as weekend detention, periodic detention, restorative justice and drug courts;

(c) employing smart policing strategies, such as using real-time crime statistics to identify and target crime hotspots;

(d) establishing in-prison education, training and rehabilitation programs aimed at reducing recidivism and improving family relationships for prisoners with children; and

(e) implementing randomised policy trials (akin to the 1999 NSW Drug Court randomised trial) to rigorously evaluate the impact of criminal justice interventions. 15   Burn injury prevention: Resumption of debate ( from 21 November 2011 ) on the motion of Mr Georganas—That this House:

(1) commemorates the ninth anniversary of the 12 October 2002 Bali bombings in which 202 people including 88 Australians died and 240 sustained injuries;

(2) notes that as a result of the attacks, survivor Julian Burton OAM was inspired to found Australia's first burn injury organisation, the Julian Burton Burns Trust;

(3) commends the work of the Julian Burton Burns Trust in implementing burn injury prevention programs, care and support services for burns patients and their families, and advancing world class research into burns treatment;

(4) recognises that:

(a) 220, 000 Australians will suffer a burn injury every year;

(b) Indigenous people living in remote areas are up to 25 times more likely to suffer a serious burns injury than those living in metropolitan areas;

(c) burn injuries cost the Australian Government $1.5 billion annually in health care costs; and

(d) the vast majority of burn injuries are preventable; and

(5) supports the esta blishment of a national burn injury prevention plan to reduce the incidence of burns in Australia and improve research, treatment and outcomes for burns patients. 20   Asbestos Awareness Week: Resumption of debate ( from 13 February 2012 ) on the motion of Ms Saffin—That this House:

(1) notes that as National Asbestos Awar eness Week is formally recognised, it makes earnest representation to the Government to continue to call on Canada to ratify the listing of chrysotile asbestos in the Rotterdam Convention on Prior Informed Consent;

(2) recognises the proactive actions of the Australian Government in mitigating the possible spread of asbestos-related diseases through continuing bans on the production and use of asbestos as well as strict controls on the removal and disposal of existing material;

(3) commends the Australian Government on a number of measures that have been put into place to manage and compensate the victims of asbestos related diseases which include:

(a) the recent ratification of the International Labour Organization (ILO) Asbestos Convention, as one of th e first ILO Conventions to be ratified by the Commonwealth Government since 2006;

(b) Australian leadership on a strong closing declaration by 66 countries at the 2011 Conference of the Rotterdam Convention, which expressed deep concern that the listing of chrysotile asbestos had been prevented by a small number of parties and resolved to move forward to list chrysotile asbestos in Annex III;

(c) the $5 million grant made to support the Asbestos Disease Research Institute Bernie Banton Centre;

(d) funding for the new Australian Mesothelioma Registry, which was launched in 2010 to gather more detailed and accurate information on mesothelioma and asbestos-related diseases;

(e) support for the harmonisation of health and safety legislation which will provide, for the first time, a uniform framework for the minimisation of exposure, the removal of asbestos, and the management asbestos materials in the workplace;

(f) the establishment of the Asbestos Management Review in late 2010 to recommend strategies for the development of a national strategic plan to improve asbestos awareness, management and removal;

(g) the loan agreement with the NSW Government to ensure asbestos victims and their families continue to receive payments through the Asbestos Injuries Compensation Fund; and

(h) the $1.5 million Comcare Asbestos Innovation Fund which sponsors programs and research to prevent and better manage asbestos exposure, as well as improve treatment for asbestos-disease sufferers;

(4) notes the unwelcome inheritanc e that asbestos has left on the Australian community, which sees Australian citizens suffering one of the highest rates of asbestos-related diseases in the world, with the effects of asbestos mining still being suffered by many, mostly Indigenous and past employees of James Hardie's operation at Baryulgil in the electoral division of Page, and the poor health and mortality they and their families suffer;

(5) extends its profound sympathies to all individuals suffering asbestos-related diseases as well as their friends and families and the friends and families of those who have passed away as a result of asbestos-related diseases;

(6) notes the current and potential damage that imported asbestos is creating to the people in the Asia Pacific region where, despite these well documented health risks, it remains an attractive commodity due to its low cost compared to other comparable building material;

(7) calls upon the Canadian Government to recognise the potentially catastrophic health and social implications of Canada's production and sale of asbestos and products containing asbestos to these lower socio-economic markets; and

(8) supports the Australian Government in using strong diplomatic efforts to convince the Canadian Government to cease both production and trade in asbestos. 21   Human rights in Iran: Resumption of debate ( from 13 February 2012—Mr Simpkins , in continuation ) on the motion of Ms Parke—That this House:

(1) expresses deep concern to our inter-parliamentary colleagues in the Iranian Parliament regarding serious and systematic human rights violations occurring in the Islamic Republic of Iran;

(2) notes the following fro m United Nations Secretary-General Ban Ki-moon's report on The situation of human rights in the Islamic Republic of Iran released in September 2011, that:

(a) Iran has stepped up its crackdown on human rights workers, women's rights activists, journalists and government opponents;

(b) since the beginning of 2011, Iran has seen a notable increase in the use of capital punishment for political and juvenile prisoners;

(c) Iran has increased discrimination, in some cases amounting to persecution, against a number of religious and ethnic minority groups;

(d) the United Nations continues to hold long-standing concerns in respect of the treatment of the Baha'i community and the trial and sentencing of seven Baha'i community leaders, which did not meet due process and fair trial requirements;

(e) there is limited enjoyment of political, economic, social and cultural rights by, inter alia, Arabs, Azeri, Baloch and Kurdish communities, and some communities of non-citizens; and

(f) since May 2011, security forces conducted raids on the home of individuals involved in the activities of the Baha'i Institute for Higher Education and arrested 15 of its members in various cities;

(3) n otes that in recent months there have been:

(a) further reports of the denial of acc ess to Iranian universities for young people on the basis of their political or religious beliefs; and

(b) prison terms of between four and five years imposed on seven Iranian Baha'is in relation to their association with the Baha'i Institute for Higher Education; and

(4) calls on the National Consultative Assembly of Iran as fellow members of the inter-parliamentary union and as the parliamentary body of a member state of the United Nations, to:

(a) promote and protect fundamental human rights irrespect ive of origin, ethnicity, sex, religion, opinion, or other status;

(b) investigate the denial of access to universities for student activists, Baha'is, and others barred from universities for reasons other than academic capability; and

(c) seeks a judicial review of the trials of prisoners of conscience, including the seven former Baha'i leaders, lawyer Ms Nasrin Sotoudeh, and other human rights defenders and lawyers. 23   orange juice concentrate imports: Resumption of debate ( from 27 February 2012 ) on the motion of Mr Secker—That this House:

(1) notes that:

(a) Australia currently permits the import of orange juice concentrate from Brazil;

(b) the Un ited States has moved to ban imports of Brazilian orange juice concentrate due to traces of the fungicide Carbendazim being found in some juice concentrates from Brazil;

(c) in January 2010, the Australian Pesticides and Veterinary Medicines Authority (APVMA) suspended some agricultural production uses of Carbendazim, including use on all citrus fruits;

(d) in 2011 the APVMA completed its preliminary review finding of Carbendazim which has proposed removing many uses of this chemical; and

(e) the APVMA has proposed a change to remove the Maximum Residue Limits in the Australia New Zealand Food Standards Code that permits Carbendazim residues in some foods, including citrus products; and

(2) calls on the Government to instruct the Australian Quarantine and Inspection Service to increase the testing on imported juice concentrate to ensure Carbendazim is n ot present at levels which risk public health.
